Exemptions from Minimum Wage, Overtime, Child Labor, and Recordkeeping

 

The following categories of employees are exempt from the minimum wage, overtime, child labor, and recordkeeping provisions of the FLSA:

  1. Employees who work in foreign countries or in certain territories under the jurisdiction of the United States - Section 213(f)

  2. Employees of non-appropriated fund instrumentalities under the jurisdiction of the Armed Forces who serve in foreign countries or in certain territories under the jurisdiction of the United States - Section 213(f), in conjunction with Sections 218(b) and 218(b)(2)
