Texas Workforce Commission (TWC), as a recipient of federal financial assistance, must provide the following notice that it does not discriminate on any prohibited ground.

It is against the law for this recipient of Federal financial assistance to discriminate on the following bases:

Recipients of federal financial assistance must take reasonable steps to ensure that communications with individuals with disabilities are as effective as communications with others. This means that, upon request and at no cost to the individual, recipients are required to provide appropriate auxiliary aids and services to qualified individuals with disabilities.

What to Do If You Believe You Have Experienced Discrimination

If you think you have been subjected to discrimination under a WIOA Title I-financially assisted program or activity, you may file a complaint within 180 days from the date of the alleged violation with either:

If you file your complaint with the recipient, you must wait either until the recipient issues a written Notice of Final Action, or until 90 days have passed (whichever is sooner), before filing with the Civil Rights Center (see address above).

If the recipient does not give you a written Notice of Final Action within 90 days of the day on which you filed your complaint, you may file a complaint with CRC before receiving that Notice. However, you must file your CRC complaint within 30 days of the 90-day deadline (in other words, within 120 days after the day on which you filed your complaint with the recipient). If the recipient does give you a written Notice of Final Action on your complaint, but you are dissatisfied with the decision or resolution, you may file a complaint with CRC. You must file your CRC complaint within 30 days of the date on which you received the Notice of Final Action.

Voluntary Disclosure for Specialized Services for People with Disabilities

The Americans with Disabilities Act and Texas Commission on Human Rights Act place limits on inquiries regarding whether an individual has a disability and to the nature and extent of such a disability. Despite said inquiry limitations, various federal and state programs are tailored to grant benefits and services to individuals based on their disability status, both veteran and non-veteran. Should you wish to have your eligibility for such services considered, please inform a TWC representative regarding any relevant disability information. This information will only be considered in relation to program qualification determinations as described above.

Although any of TWC's staff can assist you, the agency has staff specifically trained to serve veterans and clients with disabilities should you wish to receive these specialized services.

Notice Under Title II of the Americans with Disabilities Act

TWC does not discriminate against qualified individuals with disabilities in its services, programs, or activities.  TWC will make reasonable modifications in policies, practices, or procedures to avoid discrimination on the basis of disability, unless making the modifications would fundamentally alter the nature of the service, program, or activity. TWC has designated the TWC EO Officer as the ADA and Section 504 Coordinator for TWC. TWC's EO Officer advises TWC and the public about TWC's compliance obligations; and coordinates the investigation of complaints filed by the public alleging discrimination in TWC's programs, services, or activities.  The public may give requests for accommodations or modifications to any TWC staff member or contact the Equal Opportunity Compliance Department for help.

TWC works to ensure effective communication with people with disabilities.  TWC also makes appropriate auxiliary aids and services available without charge to ensure effective communication. TWC will generally, upon request, provide appropriate aids and services leading to effective communication for qualified individuals with disabilities so they can participate equally in TWC's services, programs, and activities.  These aids and services may include qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to individuals who have speech, hearing, or vision impairments.

When a qualified individual with a disability requires an auxiliary aid or service to ensure effective communication, the individual may request the auxiliary aid or service of his or her choice. TWC gives primary consideration to the choice expressed by the individual. Primary consideration means that TWC will honor the choice, unless it can show that another equally effective means of communication is available, or that use of the means chosen would result in (1) a fundamental alteration in the nature of its service, program, or activity, or (2) an undue financial or administrative burden. When the preferred type of auxiliary aid or service is not available or will not be provided, TWC will consult with the requesting individual to decide whether an alternative means of communication will ensure effective communication. TWC may ask for more information when it would be helpful in responding to the request.

TWC will notify the requesting individual whether the requested accommodation will be provided. The notification will be in writing whenever possible. If the requesting individual is not satisfied with the response, the individual may file a grievance by contacting the TWC EO Officer to file an EO complaint.  The EO complaint must be in writing.  The complaint process can be found in TWC's Nondiscrimination Plan.

TWC's Personnel Manual governs employment-related complaints of disability discrimination.  Employee and applicant accommodation requests can be submitted to ADA.Coordinator@twc.texas.gov
