Introduction

When an individual files for unemployment insurance compensation (UI) there are a number of steps that the Texas Workforce Commission (TWC) goes through to determine if that individual meets the requirements necessary to receive UI benefits. If you were the last entity for whom the claimant worked before filing a claim for benefits, the TWC will mail you a Notice of UI Application. You will have 14 days from the date that notice is mailed to protest the claim. If you protest within that 14-day period you will have appeal rights on determinations affecting claimant benefits.

An employer who timely protests the initial claim can appeal. Under certain other circumstances, other employers may appeal. An appeal is a written disagreement with our decision that requests us to hold a hearing to ensure each affected person has the chance to state his or her case.

What follows is a tutorial designed to help you further understand the appeals process, the correspondence TWC will be sending to you and the individual claimant, how to prepare for the appeal hearing and what steps you must follow in the appeal process.
