Criminal Prosecutions of Unemployment Insurance Fraud - Recent Dispositions

The Texas Workforce Commission (TWC) refers to District Attorney offices for possible criminal prosecution cases in which TWC has determined that unemployment insurance (UI) benefits were obtained by a claimant through fraud or deception.

*During the 3rd and 4th Quarters of 2011, TWC Learned the Details of the Following Dispositions:

FEDERAL PROSECUTIONS:

On 12/5/2011, Andrea Mims, 48, and Lea Ann Battles, 44, both of Cuero, Texas, were sentenced to federal prison by United States District Judge John D. Rainey, Southern District of Texas, for theft of Unemployment Insurance benefits between October 2009 and June 2011 utilizing a fictitious employer and stolen identities. The crime was jointly investigated by TWC's Office of Special Investigations, the U.S. Department of Labor Office of Inspector General, the U.S. Postal Service Office of Inspector General, and the Cuero Police Department. Specifically, Mims was ordered to spend 21 months in prison, to make $110,400 restitution, and to serve a three year term of supervised released upon release from prison. Battles was ordered to spend 27 months in prison, to make $96,222 restitution, and to serve a three year term of supervised released upon release from prison.

STATE PROSECUTIONS:

BELL COUNTY

On 10/7/11, Lester J. Hayes, 57, was convicted by the 264th District Court of Class A misdemeanor Theft and sentenced to 3 days in the Bell County Jail. Hayes was also ordered to pay $230 court costs.

DALLAS COUNTY

On 4/6/11, Will Baker, 29, received 4 years deferred adjudication probation from the 363rd District Court on the charge of state jail felony Securing Execution of Document by Deception. Baker was ordered to make $6,894 restitution, to pay a $1,500 fine and $223 court costs, and to perform 120 hours community service.
On 7/15/11, Shanequa N. Joiner, 32, received 2 years deferred adjudication probation from the 363rd District Court on the charge of state jail felony Securing Execution of Document by Deception. Joiner was ordered to make $4,116 restitution and to pay a $500 fine and $236 court costs.
On 8/2/11, Darrell W. Langley, 38, was convicted by Criminal District Court No. 2 of state jail felony Securing Execution of Document by Deception, sentenced to 5 years regular probation, and ordered to pay a $1,500 fine.
On 8/2/11, Magdalene R. Martinez, 44, received 3 years deferred adjudication probation from the 195th District Court on the charge of state jail felony Securing Execution of Document by Deception. Martinez was ordered to make $6,876 restitution and to pay a $1,500 fine.
On 8/12/11, Rebecca S. Goodman-Palo, 50, received 1 year deferred adjudication probation from the 194th District Court on the charge of Class A misdemeanor Securing Execution of Document by Deception. Goodman-Palo made full restitution of $6,270 before sentencing.
On 9/23/11, Bridgette A. Williams, 38, received 5 years deferred adjudication probation from Criminal District Court No. 7 on the charge of state jail felony Theft. Williams was ordered to make $3,150 restitution and to pay a $1,500 fine and $436 court costs.
On 10/12/11, Nancy Ortiz, 46, received 2 years deferred adjudication probation from the 265th District Court on the charge of state jail felony Securing Execution of Document by Deception. Ortiz was ordered to make $7,700 restitution and to pay a $1,000 fine and $236 court costs.
On 10/20/11, Erin S. Sweeney, 38, received 5 years deferred adjudication probation from Criminal District Court No. 7 on the charge of state jail felony Theft. Sweeney was ordered to make $5,966 restitution, to pay a $1,500 fine and $236 court costs, and to perform 120 hours community service.
On 11/10/11, Jana K. Wallace, 44, received 5 years deferred adjudication probation from the 194th District Court on the charge of state jail felony Theft. Wallace was ordered to make $3,055 restitution, to pay a $1,500 fine and $236 court costs, and to perform 120 hours community service.
On 12/12/11, Kerry Jackson, 49, received 2 years deferred adjudication probation from the 265th District Court on the charge of state jail felony Securing Execution of Document by Deception. Jackson was ordered to pay $223 court costs and to perform 120 hours community service.
On 12/21/11, Clarence Woods, 62, received 4 years deferred adjudication probation from Criminal District Court No. 6 on the charge of state jail felony Securing Execution of Document by Deception. Woods was ordered to make $3,172 restitution, to pay a $1,500 fine and $223 court costs, and to make a $200 donation to the St. Vincent de Paul Food Pantry in lieu of community service.

GALVESTON COUNTY

On 7/20/11, Karen R. Hurst, 54, received 2 years deferred adjudication probation from County Court No. 2 on the charge of Class A misdemeanor Fraudulently Obtaining Unemployment Insurance Benefits.

HARRIS COUNTY

On 4/26/11, Darryl L. Overstreet, 43, received 3 years deferred adjudication probation from the 184th District Court on the charge of state jail felony Theft. Overstreet was ordered to make $4,200 restitution and to pay a $600 fine.
On 9/1/11, Troy Hagendorf, 47, received 4 years deferred adjudication probation from the 174th District Court on the charge of state jail felony Theft. Hagendorf was ordered to make $3,280 restitution, to pay a $500 fine and to perform 160 hours community service.
On 9/19/11, Terrance W. Crawford, 45, was convicted by the 180th District Court of state jail felony Theft and sentenced to 2 days in the Harris County Jail pursuant to TEX. PEN. CODE §12.44(a).
On 9/23/11, Steven R. Appling, 45, was convicted by the 338th District Court of state jail felony Theft and, due to prior felony convictions, was sentenced to 2nd degree felony punishment of 2 years in the Texas Dept. of Corrections.
On 9/29/11, Jatonsie J. Hall, 29, received 3 years deferred adjudication probation from the 248th District Court on the charge of state jail felony Theft. Hall was ordered to make $3,472 restitution and to perform 80 hours community service.
On 10/4/11, Juan M. Garza, 35, was convicted by the 209th District Court of Class A misdemeanor Securing Execution of Document by Deception and sentenced to 2 days in the Harris County Jail. Garza was ordered to make $2,403 restitution and to pay a $600 fine.
On 6/17/11, Tina R. Holden, 27, received 3 years deferred adjudication probation from the 248th District Court on the charge of state jail felony Theft. Holden was ordered to make $3,768 restitution, to pay a $300 fine, and to perform 120 hours community service.

HIDALGO COUNTY

On 8/16/11, Abel Martinez, Jr., 32, received 5 years deferred adjudication probation from the 332nd District Court on the charge of state jail felony Theft. Martinez was ordered to make $9,464 restitution, to pay $291 court costs, and to perform 120 hours community service.

MONTGOMERY COUNTY

On 8/5/11, Scott R Sollars, 54, received 5 years deferred adjudication probation from the 410th District Court on the charge of state jail felony Theft. Sollars was ordered to make $5,376 restitution, to pay a $200 fine and $341 court costs, and to perform 120 hours community service.

TRAVIS COUNTY

On 4/6/11, Gloria R. Workman, 54, was convicted by the 390th District Court of state jail felony Securing Execution of Document by Deception and sentenced to 11 months state jail time.
On 4/8/11, Orva D. McCoy, 37, was convicted by the 127th District Court of Class A misdemeanor Securing Execution of Document by Deception and sentenced to 6 months regular probation. McCoy made full restitution of $3,438 before sentencing and was ordered to pay a $200 fine and $275 court costs.
On 4/11/11, Donna G. Mick, 51, received 1 year deferred adjudication probation from the 331st District Court on the charge of Class A misdemeanor Securing Execution of Document by Deception. Mick made full restitution of $3,854 before sentencing and was ordered to perform 80 hours community service.
On 4/26/11, Damon A. Bradley, 34, received 3 years deferred adjudication probation from the 167th District Court on the charge of state jail felony Securing Execution of Document by Deception. Bradley was ordered to make $4,159 restitution.
On 5/13/11, Steve Martinez, 47, received 4 years deferred adjudication probation from the 299th District Court on the charge of state jail felony Securing Execution of Document by Deception. Martinez was ordered to make $4,780 restitution, to pay $293 court costs, and to perform 40 hours community service.
On 5/20/11, Marshall P. Fryer, 55, received 1 year deferred adjudication probation from the 403rd District Court on the charge of Class A misdemeanor Securing Execution of Document by Deception. Fryer made full restitution of $4,068 before sentencing, and was ordered to pay $171 court costs and to perform 40 hours community service.
On 5/26/11, Norman R. Tarver, 57, received 5 years deferred adjudication probation from the 299th District Court on the charge of state jail felony Theft. Tarver was ordered to make $8,300 restitution.
On 6/1/2011, April Farrell pleaded guilty before the 403rd District Court to Terroristic Threat (TEX. PEN. CODE § 22.07(a)(6)), a third degree felony, for making threats against TWC employees after being denied unemployment benefits. She received three years deferred adjudication probation with the following conditions: 1) have no contact with the hearing officer she threatened, 2) find and keep employment, 3) undergo substance abuse and mental health evaluation, and 4) undergo treatment and counseling as recommended by the probation department.
On 7/15/11, Johnny R. Ramirez, 52, received 3 years deferred adjudication probation from the 427th District Court on the charge of state jail felony Securing Execution of Document by Deception. Ramirez was ordered to make $5,890 restitution and to perform 100 hours community service.
On 8/3/11, Charles A. Fields, 48, received 2 years deferred adjudication probation from the 427th District Court on the charge of state jail felony Securing Execution of Document by Deception. Fields was ordered to make $5,290 restitution and to pay $266 court costs.
On 8/12/11, Kelly D. Gray, 50, received 4 years deferred adjudication probation from the 167th District Court on the charge of state jail felony Securing Execution of Document by Deception. Gray was ordered to make $6,309 restitution and to perform 120 hours community service.
On 8/12/11, Floyd J. Crenwelge, 34, was convicted by the 167th District Court of Class A misdemeanor Securing Execution of Document by Deception and sentenced to 20 days county jail time. Crenwelge made full restitution of $4,940 before sentencing and was ordered to pay $260 court costs.
On 8/26/11, Derwin D. West, 40, received 3 years deferred adjudication probation from the 403rd District Court on the charge of state jail felony Securing Execution of Document by Deception. West was ordered to make $6,330 restitution and to perform 100 hours community service.
On 9/6/11, John M. Ocejo, 35, received 2 years deferred adjudication probation from the 390th District Court on the charge of Class A misdemeanor Theft. Ocejo was ordered to make $1,245 restitution and to perform 80 hours community service.
On 9/15/11, Charles G. Purdy, 51, was convicted by the 147th District Court of state jail felony Securing Execution of Document by Deception and sentenced to 5 years regular probation. Purdy was ordered to serve 75 days in Travis County jail, to pay a $2,000 fine and $366 court costs, and to perform 200 hours community service.
On 9/26/11, Mike B. Nieto, 40, was convicted by the 147th District Court of Class A misdemeanor Securing Execution of Document by Deception and sentenced to 1 day Travis County jail time. Nieto was ordered to pay a $500 fine and $241 court costs.
On, 9/30/11, April L. Fields, 37, received 5 years deferred adjudication probation from the 299th District Court on the charge of state jail felony Theft. Fields was ordered to make $3,772 restitution, to pay $306 court costs, and to perform 50 hours community service.
On 10/13/11, Katrina F. Freeman, 42, received 2 years deferred adjudication probation from the 147th District Court on the charge of Class A misdemeanor Theft. Freeman was ordered to make $4,365 restitution, to pay $279 court costs, and to perform 100 hours community service.
On 11/3/11, Shabadu A. Odinga, 56, received 2 years deferred adjudication probation from the 427th District Court on the charge of Class A misdemeanor Securing Execution of Document by Deception. Odinga made $8,000 restitution before sentencing and was ordered to make $4,000 restitution and to perform 80 hours community service while on probation.
On 11/18/11, Bryan P. Cooke, 36, received 2 years deferred adjudication probation from the 199th District Court on the charge of Class A misdemeanor Securing Execution of Document by Deception. Cooke was ordered to make $4,815 restitution.
On 11/22/11, Wilmer Brookins, 38, received 2 years deferred adjudication probation from the 390th District Court on the charge of Class A misdemeanor Securing Execution of Document by Deception. Brookins was ordered to pay $279 court costs and to perform 80 hours community service.
On 11/23/11, Kathleen Betts, 50, received 4 years deferred adjudication probation from the 194th District Court on the charge of state jail felony Theft. Betts was ordered to make $7,915 restitution, to pay $232 court costs, and to perform 120 hours community service.
On 11/29/2011, the Travis County District Attorney's Office proceeded with the criminal trial of Darrell J. Harper for making a terroristic threat against TWC staff by faxing such threat as part of his appeal of an Unemployment Insurance decision. On 11/30/2011, the jury found Harper guilty of the offense charged. Sentencing for this offense is pending.
On 12/1/11, Richard Hysquierdo, 44, received 2 years deferred adjudication probation from the 403rd District Court on the charge of Class A misdemeanor Theft. Hysquierdo made $2,727 restitution before sentencing and was ordered to pay $271 court costs and to perform 40 hours community service.
On 12/6/11, Tameka C. Brantley, 31, received 4 years deferred adjudication probation from the 147th District Court on the charge of state jail felony Securing Execution of Document by Deception. Brantley was ordered to make $7,495 restitution, to pay a $500 fine and $211 court costs, and to perform 50 hours community service.

On 1/12/11, Leonard D. Staley, 55, received 2 years deferred adjudication probation from the 437th District Court on the charge of state jail felony Securing Execution of Document by Deception. Staley made $4,528 restitution before sentencing and was ordered to pay a $500 fine and to perform 100 hours community service.
On 2/7/11, Alvie S. Young, 48, received 2 years deferred adjudication probation from the 399th District Court on the charge of state jail felony Theft. Young made restitution before sentencing and was ordered to perform 200 hours community service and to take a Theft course.

On 1/20/11, Shinita L. Butler, 26, received 3 years deferred adjudication probation from Criminal District Court No. 7 on the charge of state jail felony Theft. Butler made restitution before sentencing and was ordered to pay $436 court costs.

On 2/14/11, Stephanie R. Rockwell, 34, received 5 years deferred adjudication probation from the 413th District Court on the charge of state jail felony Theft. Rockwell was ordered to make $3,947 restitution, and to pay a $250 fine and $288 court costs.

FEDERAL PROSECUTIONS:

The Fraud Prosecutions Unit has been working with the U.S. Treasury Dept. Inspector General for Tax Administration (TIGTA) to prosecute a number of Austin and San Antonio area Internal Revenue Service (IRS) employees (most now "former" IRS employees) for committing Unemployment Insurance fraud, i.e., working for the IRS while simultaneously filing for Unemployment benefits and not reporting work or earnings to TWC. The initial investigations in these cases were performed by the Benefits Investigations Unit of TWC's Office of Investigations.

On 9/17/2010, in the first of these cases, Mona K. Alexander pleaded guilty before U.S. Magistrate Judge Robert Pitman, United States District Court, Western District of Texas, Austin Division, to Theft of Public Funds (18 United States Code § 641) in an amount above $1,000. On 11/29/2010, Alexander was found guilty and sentenced to 3 years supervised probation. Alexander made $11,553 restitution before sentencing.

On 9/20/10, Maryetta F. Owens, 57, received 5 years deferred adjudication probation from the 187th District Court on the charge of state jail felony Theft. Owens was ordered to make $4,121 restitution and to pay a $2,000 fine.

While employed by the U.S. Postal Service, Jackson filed a series of false claims for unemployment insurance benefits with TWC, stealing $15,678. On 5/15/09, Cynthia Brown was sentenced by the United States District Judge Sidney A. Fitzwater, Northern District of Texas, Dallas Division, to 33 months incarceration, followed by two years supervised release, for Fraudulent Use of a Social Security Account Number (Brown pleaded guilty on 2/13/09). Among other things, Brown used a stolen identity to file a false unemployment insurance claim totaling $5,757. Brown was ordered to make $5,757 restitution to TWC and to pay a $400.00 special assessment. Judge Fitzwater ordered the following conditions for Brown's supervised release: no employment in financial collections and no fiduciary position with access to credit information unless approval is obtained from supervision authorities and notice is given to the potential employer.
On 6/9/09, Leola G. Bernard was sentenced by United States District Judge Marcia Crone, Eastern District of Texas, Beaumont, to 6 months prison, with 3 years supervised release following prison, for Mail Fraud. While employed by the U.S. Postal Service, Bernard filed a series of false claims for unemployment insurance benefits with TWC, stealing $30,000. The benefit checks were sent to Bernard through the United States Postal Service. As part of the sentence, Bernard was ordered to make $30,000 restitution and to pay a $100 Special Assessment.

STATE PROSECUTIONS:

BEXAR COUNTY

On 1/5/09, Michael B. Morse, 52, was convicted by the 399th District Court of state jail felony theft and sentenced to 3 years regular probation. Morse was ordered to make $6,472 restitution, to pay a $1,000 fine and $293 court costs, and to perform 160 hours community service.
On 1/20/09, Richard O. Dibrell, 48, was convicted by the 227th District Court of state jail felony theft and sentenced to 5 years regular probation. Dibrell was ordered to pay a $250 fine and $298 court costs.
On 2/19/09, Wendi L. Palmer, 34, was convicted by the 290th District Court of state jail felony theft and sentenced to 3 years regular probation. Palmer was ordered to make $3,627 restitution and to pay a $1,500 fine.
On 3/30/09, Lynda Cerna was convicted by the 226th District Court of state jail felony theft and sentenced to 14 months in state jail. Cerna is a former TWC San Antonio Call Center employee who left TWC, stole multiple identities, and then used her inside knowledge of the UI process to file false claims ($14,534 provable).
On 4/3/09, Juan M. Martinez, 45, received 4 years deferred adjudication probation from the 379th District Court on the charge of state jail felony securing execution of document by deception. Martinez was ordered to make $4,626 restitution, and to pay a $1,500 fine and $293 court costs.
On 6/1/09, Gretta M. Sheppard-Nation, 43, was convicted by the 227th District Court of state jail felony Theft and sentenced to 3 years regular probation. Sheppard-Nation was ordered to make $3,410 restitution, to pay a $500 fine, and to perform 520 hours community service.

On 2/25/09, Michael Avery, 40, was convicted by the 361st District Court of state jail felony theft and sentenced to 2 days jail time. Avery made $4,592 restitution before sentencing and was ordered to pay a $1,000 fine.

On 6/15/09, Eloy Gomez, 31, received 2 years deferred adjudication probation from the 107th District Court on the charge of state jail felony Securing Execution of Document by Deception. Gomez was ordered to make $4,000 restitution.
